Safe Hiring Expert On Background Checks

justice statue with sword and scale. cloudy sky in the backgrounAttorney Lester Rosen is experienced testifying as an expert witness on safe hiring.  Rosen is founder and CEO of Employment Screening Resources.  He notes that the numbers of lawsuits, particularly class action suits, against employers over background checks are growing. “These lawsuits are most frequently brought under a federal law that controls the process of pre-employment background checks in the United States, the Fair Credit Reporting Act (FCRA).”

In 2015, plaintiff Irene Fernandez claimed that when she applied for a job with Home Depot, she signed background check authorization forms with more than the legally required disclosure. $1.8M was awarded to members of the class action settlement agreement with Home Depot. Rosen explains that “part of the reason that FCRA class action lawsuits make a tempting target is that the damages being sought can be enormous.”

Hiring regulation legislation in the works includes “ban-the-box.” This change to pre-employment procedures would prohibit employers from asking applicants to check a box on an employment form if they have been convicted of a crime.
