Medical Expert & Baby Injury Case

Prosecutors said Tuesday they will not proceed in the case of an  Appomattox County, VA,  man charged with injuring a baby in December 2009. Assistant Commonwealth’s Attorney Brooke Sterne said in a brief hearing Tuesday morning that a medical expert’s report delivered two weeks ago called the timing of the two-month-old boy’s injuries into question.

Travis Wayne Kerr, of Rough Creek Road, was charged with aggravated malicious wounding of a two-month-old boy he had been babysitting on Dec. 21, 2009.   Kerr’s defense from the outset had been that someone else inflicted the injuries on the boy before he was taken to Kerr’s home that morning. He had been jailed for 11 months before being released on bond in November when a medical expert he hired testified the child’s head injuries had been inflicted over a period of weeks.
