Gynecological Surgery Expert Witness Will Testify For Bard In MDL

Gynecological surgery expert witness Dr. Marshall Austin will be the next expert to testify for C.R. Bard Inc. in the MDL case being tried in West Virginia.  U.S. District Judge Joseph R. Goodwin will hear all federal vaginal mesh lawsuits against Bard and other transvaginal and bladder sling manufacturers. There may be as many as 10,000 federal cases as well as several thousand in state court systems.  Plaintiffs allege serious internal injuries.

Dr. Austin is expected to testify on whether the materials used in the Avaulta pelvic mesh products are compatible with human tissue.  Dr. Austin is Medical Director of Cytopathology and staff pathologist in Gynecologic and Breast Surgical Pathology. Dr. Austin oversees the weekly Gynecologic Oncology tumor board held in conjunction with Gynecologic Oncvology. Dr. Austin’s research focus over the past several decades has been on cervical screening, risk stratification, and risk management.

Bard agreed to pay $48.26 million in 2013 to resolve kickback allegations regarding false claims to Medicare.
