Environmental Pollution Expert Witnesses & Clean Air Act Decision

Environmental pollution expert witnesses may write reports and testify on hazardous waste management, chemical and refinery processes, environmental project management, and air pollution control. On February 24, 2014, Waco, TX, Federal District Judge Walter S. Smith, Jr. ruled that the Sierra Club failed to prove the Big Brown Power Plant in Freestone County violated the Clean Air Act.  The environmental group’s expert witness testified that the plant’s control devices are too small to handle the amount of emissions and alleges the company has known that since 1997.  The Sierra Club sued the plants owners, Energy Future Holdings Corporation and Luminant Generation Company for polluting the air and endangering the ecology of the region. Luminant is the largest generator of electricity in Texas.

Big Brown generators burn lignite coal, which the Sierra Club says is the source of contamination.  The lawsuit requested more than $330 million in civil penalties and sought an injunction requiring Luminant to replace the existing emissions control equipment at a cost of approximately $140 million.
