Drug Recognition Expert Witness Testimony

The York Daily Record reports: “It may take a legal challenge before a police officer trained to spot drugged drivers testifies in front of a York County, PA, jury.  Although Drug Recognition Expert testimony has been recognized as expert witness testimony in Butler County, it was rejected by a Lebanon County court. And to date, it has not been part of a Common Pleas Court case in York County.

The DRE claim is that it can determine which of seven categories of drugs — stimulants, depressants, hallucinogens, anesthetics, narcotics, inhalants and cannabis — an impaired driver likely is on.”
