Industrial Hygiene Expert Witness On Lumber Liquidators Violations

Lumber Liquidators pleaded guilty today for violations of the Lacey Act and will pay $10M in fines and penalties. The DOJ investigation found that Lumber Liquidators smuggled illegal wood from the Russian Far East. The company was found guilty of the felony for entry of goods by means of false statements and four misdemeanor counts of violating the Lacey Act. Lumber Liquidators has been placed on a 5 year probationary period to implement an environmental compliance plan.

Defense attorney Bob Hilliard presented expert witness opinion in the Pennsylvania manslaughter case against Lakisha Ward-Green. Ward-Green was charged in the death of Robert Chambers IV. She was driving 75 mph in a 35-mph zone when she crashed into a utility pole. The defense said the victim was not wearing a seat belt and air bags did not open upon impact. Judge Phillip Ignelzi, Alleghany County Court of Common Pleas, set aside Ward-Green’s conviction.

Expert Witness Allowed In Case v. Colgate-Palmolive Co.

In Linda Fishbain and David Fishbain v. Colgate-Palmolive Co., et al., Judge Ana Viscomi is allowing the plaintiff’s expert witness to testify for the mesothelioma victim. The Middlesex County proceeding will consider whether two cosmetic talcum powder products caused the plaintiff’s mesothelioma. Fishbain alleges that the products she used in for twenty years were contaminated with asbestos.

Engineering Expert Witness On Takata Recall

In the news, Mark Rosekind, administer of the NHTSA, said that a faulty Takata airbag inflator was involved in the fatal crash of a rental car in California last September. This brings the death toll to eight with more than 100 injuries in the US. Takata announced that 33.8 million air bags are defective after they were found to explode and send shrapnel into the face and body of motorists. The recall is complicated by the news that some cars that had already undergone service would need a second airbag replacement. Retired Takata engineer Mark Lillie has said he will be testifying as an expert witness or “someone with knowledge of Takata in particular” regarding the chemicals used in the air bag inflators.
