Antitrust Expert Witnesses

What areas of law may antitrust expert witnesses opine on? These experts may consult on antitrust practices, price-fixing, monopolies, and related matters.  In the news, agents from China’s State Administration for Industry and Commerce made a surprise visit to Microsoft’s offices in China.  The investigators not only copied contracts and financial records but also downloaded data from MS computers.

Last week Daimler had a Chinese official visit who said the automobile company is being investigated for “monopolistic behavior.”

On its website, the United States Department of Justice Antitrust Division describes antitrust laws:

Federal antitrust laws apply to virtually all industries and to every level of business, including manufacturing, transportation, distribution, and marketing. They prohibit a variety of practices that restrain trade, such as price-fixing conspiracies, corporate mergers likely to reduce the competitive vigor of particular markets, and predatory acts designed to achieve or maintain monopoly power.
